Terms & Conditions
These Terms and Conditions govern the relationship between Sama Transportation and our clients. By making a booking with us — whether by phone, WhatsApp, email, or through our website — you agree to be bound by these terms. If you do not agree with any part of these terms, please do not proceed with your booking.
We have written these terms in plain, straightforward language because we believe our clients deserve clarity. If you have any questions about anything contained in this document, please contact us before making your booking and we will be happy to clarify.
1. Definitions
In these Terms and Conditions, the following definitions apply:
“Sama Transportation”, “we”, “us”, or “our” refers to Sama Transportation, a luxury transport company based in Cape Town, South Africa.
“Client”, “you”, or “your” refers to the individual, company, or organisation making a booking with Sama Transportation, including any person travelling as a passenger as part of that booking.
“Booking” refers to any confirmed reservation for transport services, vehicle hire, or tour services made with Sama Transportation.
“Journey” refers to any transport service provided by Sama Transportation pursuant to a confirmed booking.
“Vehicle” refers to any vehicle from the Sama Transportation fleet used to provide a journey.
“Chauffeur” or “Driver” refers to any professional driver employed or contracted by Sama Transportation to provide transport services.
“Services” refers to all transport, vehicle hire, tour, and related services provided by Sama Transportation.
“Optional Extras” refers to additional equipment or services available at extra cost, including baby car seats, luggage trailers, roof storage boxes, and any other special arrangements.
2. Bookings & Confirmations
2.1 Making a Booking Bookings can be made by contacting Sama Transportation via phone, WhatsApp, or email. A booking is not confirmed until you have received a written confirmation from Sama Transportation acknowledging the details of your journey.
2.2 Booking Information When making a booking, you are required to provide accurate and complete information including your full name, contact details, pickup location, destination, date and time of travel, number of passengers, luggage requirements, and any special requests or requirements. Sama Transportation accepts no responsibility for any issues arising from inaccurate or incomplete information provided at the time of booking.
2.3 Booking Confirmation Upon confirmation of your booking, you will receive a written confirmation containing the details of your journey, the vehicle assigned, and your driver’s contact information. It is your responsibility to review this confirmation carefully and notify us immediately of any errors or discrepancies.
2.4 Third-Party Bookings Where a booking is made on your behalf by a third party — including a travel agent, wedding planner, event coordinator, or corporate client — the third party is responsible for ensuring that all information provided is accurate and that you are aware of and agree to these Terms and Conditions.
2.5 Availability All bookings are subject to vehicle and driver availability. We recommend booking as early as possible, particularly for weddings, events, tours, and peak travel periods. Confirmation of a booking does not guarantee a specific vehicle model unless this has been explicitly agreed in writing.
3. Pricing & Payment
3.1 Quotations All prices quoted by Sama Transportation are provided in South African Rand (ZAR) unless otherwise stated. Quotations are valid for the period specified at the time of quoting and are subject to change if the details of the booking change.
3.2 What Is Included Unless otherwise specified in writing, the quoted price covers the vehicle and professional chauffeur for the agreed journey or hire period. The following are not included in the standard quoted price unless explicitly stated:
- Fuel costs for self-drive vehicle hire
- Toll fees and parking charges incurred during the journey
- Entrance fees, activity costs, and meal costs during tours
- Wine tasting fees and cellar tour costs
- Accommodation costs
- Optional extras including baby car seats, luggage trailers, and roof storage boxes
3.3 Additional Charges Additional charges may apply in the following circumstances:
- Waiting time beyond the agreed allowance
- Journeys that exceed the agreed distance or duration
- Changes to the booking that result in additional costs
- Optional extras requested at the time of booking or during the journey
- Late night or early morning surcharges where applicable
- Public holiday surcharges where applicable
All additional charges will be communicated clearly before they are incurred where possible, or as soon as practicable thereafter.
3.4 Payment Terms Payment terms vary depending on the nature and value of the booking. Standard payment terms will be communicated at the time of booking confirmation. For certain bookings — including weddings, tours, multi-day hire, and large group transport — a deposit may be required to secure the reservation.
3.5 Deposit Requirements Where a deposit is required, the amount and payment deadline will be specified in your booking confirmation. Failure to pay the required deposit by the specified deadline may result in the cancellation of your booking. Deposits are non-refundable unless Sama Transportation cancels the booking.
3.6 Late Payment Where payment is not received by the agreed due date, Sama Transportation reserves the right to cancel the booking, withhold services, or charge interest on the outstanding amount at a reasonable rate.
3.7 Payment Methods Accepted payment methods will be communicated at the time of booking. Sama Transportation reserves the right to refuse payment by certain methods at its discretion.
4. Cancellations & Amendments
4.1 Cancellation by the Client If you need to cancel a confirmed booking, please notify us as soon as possible. The following cancellation terms apply:
Standard Transfers & Chauffeur Bookings:
- Cancellation more than 24 hours before the scheduled journey — no cancellation fee
- Cancellation between 12 and 24 hours before the scheduled journey — 50% of the quoted fare
- Cancellation less than 12 hours before the scheduled journey — 100% of the quoted fare
- No-show — 100% of the quoted fare
Wedding, Event & Tour Bookings:
- Cancellation more than 30 days before the booking date — deposit forfeited
- Cancellation between 14 and 30 days before the booking date — 50% of the total quoted price
- Cancellation less than 14 days before the booking date — 100% of the total quoted price
Multi-Day & Extended Hire Bookings:
- Cancellation more than 14 days before the start of the hire period — deposit forfeited
- Cancellation less than 14 days before the start of the hire period — 100% of the total quoted price
4.2 Cancellation by Sama Transportation In the unlikely event that Sama Transportation is required to cancel a confirmed booking, we will notify you as soon as possible and offer you the choice of an alternative booking or a full refund of any amounts paid. Sama Transportation’s liability in the event of cancellation is limited to the refund of amounts already paid and does not extend to any consequential losses or expenses incurred by the client.
4.3 Amendments to Bookings Requests to amend a confirmed booking — including changes to pickup time, location, destination, vehicle type, or passenger numbers — must be made as early as possible. Amendments are subject to availability and may result in a change to the quoted price. We will confirm any amended booking and any change in price in writing before the amendment is finalised.
4.4 Force Majeure Sama Transportation shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, extreme weather conditions, civil unrest, government action, pandemics, or any other event outside our control. In such circumstances, we will make every reasonable effort to fulfil our obligations or to offer an alternative arrangement.
5. Airport Transfers
5.1 Flight Monitoring For airport transfer bookings, Sama Transportation will monitor your flight and adjust the driver’s schedule accordingly in the event of a delay or early arrival. This service is provided as a courtesy and Sama Transportation accepts no liability for any failure of flight tracking systems or for circumstances beyond our control.
5.2 Waiting Time — Arrivals For arrival transfers, a standard waiting period of 60 minutes from the actual landing time of your flight is included in the quoted price to allow for disembarkation, baggage collection, and customs clearance. Waiting time beyond this standard allowance may be subject to an additional charge.
5.3 Waiting Time — Departures For departure transfers, your driver will arrive at the agreed pickup location at the agreed time. If you are not ready to depart at the agreed time, a waiting time charge may apply after a grace period of 15 minutes.
5.4 Meeting Point Your driver will meet you in the arrivals hall with a name board displaying your name. It is your responsibility to proceed to the arrivals hall in a timely manner. If you are unable to locate your driver, please contact them directly using the contact details provided in your booking confirmation.
5.5 Flight Cancellations In the event that your flight is cancelled, please notify Sama Transportation as soon as possible. We will make every effort to accommodate any rescheduled travel arrangements, subject to availability.
6. Vehicle & Fleet
6.1 Vehicle Assignment Sama Transportation will assign an appropriate vehicle from our fleet for your journey based on your requirements and the vehicle type agreed at the time of booking. While we will make every effort to provide the specific vehicle model requested, we reserve the right to substitute a vehicle of equivalent or superior standard where the requested vehicle is unavailable due to circumstances beyond our control.
6.2 Vehicle Condition All vehicles are regularly maintained, serviced, and inspected to ensure they are safe, clean, and in excellent mechanical condition. In the unlikely event that a vehicle suffers a mechanical failure during your journey, we will make every effort to arrange a replacement vehicle as quickly as possible.
6.3 Passenger Capacity Passengers must not exceed the legal seating capacity of the vehicle. Sama Transportation reserves the right to refuse transport to passengers in excess of the vehicle’s legal capacity.
6.4 Luggage Capacity Luggage must be within the reasonable carrying capacity of the vehicle booked. Sama Transportation accepts no responsibility for damage to luggage carried in the vehicle or trailer. Clients are responsible for ensuring their luggage is properly packed and secured.
6.5 Vehicle Cleanliness Passengers are required to maintain the cleanliness of the vehicle during their journey. Smoking is strictly prohibited in all Sama Transportation vehicles. Eating and drinking in vehicles is permitted at the driver’s discretion.
6.6 Damage to Vehicles The client is liable for any damage caused to a Sama Transportation vehicle by the client or their passengers during the journey, including damage caused by spillage, soiling, or any other act or omission. The cost of repairing or cleaning the vehicle will be charged to the client.
7. Passenger Conduct
7.1 Behaviour All passengers are expected to conduct themselves in a respectful, lawful, and considerate manner during their journey. Sama Transportation reserves the right to terminate a journey at any time where a passenger’s behaviour is deemed by the driver to be threatening, abusive, disruptive, or otherwise unacceptable. In such circumstances, no refund will be provided.
7.2 Alcohol & Substances Passengers who are visibly intoxicated or under the influence of illegal substances may be refused transport at the driver’s discretion. No refund will be provided in such circumstances.
7.3 Seatbelts All passengers are required to wear seatbelts at all times while the vehicle is in motion. It is the passenger’s responsibility to ensure that they and any children travelling with them are properly restrained at all times.
7.4 Children & Baby Car Seats Clients travelling with infants or young children are responsible for requesting a baby car seat at the time of booking. Sama Transportation will make every effort to provide a properly fitted and age-appropriate car seat where requested. It is the client’s responsibility to ensure that the child is properly secured in the car seat for the duration of the journey.
7.5 Animals Animals are not permitted in Sama Transportation vehicles without prior written agreement. Where animals are permitted by prior arrangement, they must be properly contained and secured for the duration of the journey.
8. Self-Drive Vehicle Hire
8.1 Driver Requirements Clients hiring a vehicle on a self-drive basis must hold a valid driver’s licence appropriate for the class of vehicle being hired. International visitors must present their home country licence along with a valid International Driving Permit where required by South African law.
8.2 Age Requirements The minimum age for self-drive vehicle hire is 23 years unless otherwise agreed in writing. Sama Transportation reserves the right to require additional documentation or impose additional conditions for drivers under the age of 25.
8.3 Authorised Drivers Only the client named in the booking confirmation is authorised to drive the hired vehicle unless additional drivers have been agreed in writing at the time of booking. Sama Transportation accepts no liability for any incident involving an unauthorised driver.
8.4 Vehicle Condition at Collection The client is required to inspect the vehicle at the time of collection and sign a vehicle condition report. Any pre-existing damage must be noted on the condition report before departure. The client accepts responsibility for any damage not noted on the condition report at collection.
8.5 Vehicle Return The vehicle must be returned at the agreed time and location in the same condition as it was collected, with a full tank of fuel unless otherwise agreed. Late returns may be subject to additional charges.
8.6 Traffic Violations & Fines The client is solely responsible for any traffic violations, fines, tolls, or penalties incurred during the self-drive hire period. Any fines or penalties received by Sama Transportation in connection with the client’s hire will be recovered from the client.
8.7 Accidents & Incidents In the event of an accident or incident during a self-drive hire, the client must immediately notify the relevant authorities and Sama Transportation. The client must not admit liability to any third party without the prior written consent of Sama Transportation.
9. Tours
9.1 Tour Inclusions Unless otherwise specified in writing, tour pricing covers the vehicle and professional chauffeur for the agreed tour duration. Entrance fees, wine tastings, meals, activity costs, and accommodation are not included unless explicitly stated in your booking confirmation.
9.2 Tour Itineraries Suggested tour itineraries are provided as a guide only and are subject to change based on weather conditions, venue availability, traffic conditions, and other factors beyond our control. Sama Transportation will make every effort to deliver the agreed itinerary but accepts no liability for any changes necessitated by circumstances beyond our control.
9.3 Third-Party Activities Where a tour includes activities operated by third parties — including wine tastings, game drives, boat trips, shark cage diving, and similar experiences — Sama Transportation acts as a transport provider only and accepts no responsibility for the conduct, safety, or quality of third-party services.
9.4 Weather The Western Cape’s weather can be unpredictable. Sama Transportation does not accept responsibility for any disruption to tour itineraries caused by adverse weather conditions. Where a tour is significantly impacted by weather, we will make every effort to offer an alternative arrangement.
10. Liability & Indemnity
10.1 Limitation of Liability Sama Transportation’s liability to the client in respect of any claim arising from the provision of services is limited to the amount paid by the client for the specific service giving rise to the claim.
10.2 Exclusion of Consequential Loss Sama Transportation accepts no liability for any indirect, consequential, or special loss or damage arising from the provision of or failure to provide services, including but not limited to missed flights, missed connections, missed events, loss of business, loss of income, or any other consequential loss.
10.3 Personal Injury Sama Transportation maintains appropriate insurance for passenger liability. Nothing in these Terms and Conditions limits or excludes any liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence.
10.4 Personal Belongings Sama Transportation accepts no responsibility for any loss of or damage to personal belongings left in a vehicle. Clients are advised to ensure that all personal belongings are removed from the vehicle at the end of each journey.
10.5 Delays & Late Arrivals Sama Transportation will make every reasonable effort to ensure punctual service. However, we accept no liability for delays caused by circumstances beyond our reasonable control, including traffic congestion, road closures, adverse weather, accidents, mechanical failure, or any other unforeseen circumstances.
10.6 Client Indemnity The client indemnifies Sama Transportation against any claims, losses, damages, costs, or expenses arising from the client’s breach of these Terms and Conditions, the client’s negligence, or the conduct of the client’s passengers during a journey.
11. Insurance
11.1 Sama Transportation Insurance Sama Transportation maintains appropriate public liability and passenger liability insurance for all chauffeur-driven services. Details of our insurance coverage are available on request.
11.2 Self-Drive Insurance For self-drive vehicle hire, the client is responsible for ensuring that appropriate insurance coverage is in place for the duration of the hire period. Details of insurance arrangements for self-drive hire will be provided at the time of booking.
11.3 Client’s Own Insurance Clients are responsible for ensuring that they have appropriate personal travel insurance in place for their journey, including coverage for cancellation, personal belongings, and any activities undertaken during tours.
12. Privacy & Data Protection
Sama Transportation collects and processes personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By making a booking with us, you consent to the collection and processing of your personal information as described in our Privacy Policy, which is available on our website and upon request.
13. Complaints & Dispute Resolution
13.1 Complaints Procedure If you are dissatisfied with any aspect of our service, we encourage you to contact us as soon as possible so that we can address your concern promptly. Complaints can be submitted by email, phone, or WhatsApp using the contact details provided below.
13.2 Response Time We will acknowledge all complaints within 48 hours and aim to provide a full response within 7 business days. Complex complaints may take longer to resolve and we will keep you informed of progress throughout the process.
13.3 Dispute Resolution In the event that a complaint cannot be resolved through our internal complaints process, both parties agree to attempt to resolve the dispute through good faith negotiation before pursuing any formal legal proceedings.
13.4 Governing Law These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or from the provision of our services shall be subject to the jurisdiction of the South African courts.
14. General Provisions
14.1 Entire Agreement These Terms and Conditions, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Sama Transportation in relation to the services booked. They supersede all prior discussions, representations, and agreements.
14.2 Amendments Sama Transportation reserves the right to amend these Terms and Conditions at any time. The current version of the Terms and Conditions will always be available on our website. Amendments will not affect bookings that have already been confirmed under a previous version of the terms.
14.3 Severability If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining terms, which will continue in full force and effect.
14.4 Waiver A failure by Sama Transportation to enforce any provision of these Terms and Conditions at any time does not constitute a waiver of our right to enforce that provision in the future.
14.5 Assignment The client may not transfer or assign any rights or obligations under these Terms and Conditions to any third party without the prior written consent of Sama Transportation.
